Smoky Mountain Escapes Vacation Rentals,LLC

Smoky Mountain Escapes Rental Company agrees to rent a private condo/home at the rental rate stated in your Reservation Confirmation to the party signing for the dates listed on your confirmation. 

Reservation Deposits: A prepayment of 1st night plus taxes and your Vacation Guarantee policy is required when your reservation is made. The remainder of your balance is due, for homes, 30 days prior to arrival. Reservation deposits are not held in an escrow account regulated by the Tennessee Real Estate Commission

METHODS OF PAYMENT: We accept Visa, MasterCard, American Express, and Discover credit cards.

RENTER: The renter understands that we will accept responsible adults 25 years of age or older. Smoky Mountain Escapes does not rent to high school, college individuals or party groups. The person signing the rental agreement must occupy the premises for the entire length of the reservation. Each rental is limited to the number of people indicated on your reservation. If guests are found to exceed the maximum occupancy of the property, Smoky Mountain Escapes reserves the right to charge additional fees as well as the right to request guests to vacate the property with no refunds. Prior arrangements must be made with our office if any items will be mailed or shipped to you during your stay. 

GUEST SECURITY DEPOSIT FOR DAMAGES: The guest agrees to provide a valid credit card account to be held for a Security Deposit. Smoky Mountain Escapes and its entities shall conduct a Check-Out inspection of the property after each guest departure. Should damages be evident during the inspection, the Guest authorizes the Agent to charge the Guest’s credit card for any damages, including but not limited to excessive cleaning or any unnecessary service calls that occur during the Guest’s occupancy. If the Guest’s credit card is charged, a receipt and documentation will be sent to the Guest within 45 days of departure. 

CANCELATION POLICY: If you cancel your vacation rental reservation before 30 days of your arrival, you will forfeit a $25 cancelation fee and the cost of the vacation guarantee. The remainder of your deposit will be refunded to the card used to make payment. This can take up to 10 business days to show on your side but will be done the same day of your cancellation from Smoky Mountain Escapes. If you cancel 30 days or less of your arrival date, there will be no refunds, a credit voucher made possible by the purchase of our Vacation Guarantee will be issued and emailed to the guest on file.

VACATION GUARANTEE: Protect your travel investment. This policy allows you to cancel up until your day of arrival with no questions asked. Vacation Guarantee is NON-REFUNDABLE & is charged at time of booking. This policy is 6% of your rental amount. In the event  that you need to cancel inside the 30-day cancellation period and you have purchased the Vacation Guarantee policy at the time of booking, you will be given a credit voucher for the amount of money paid LESS the amount of the Vacation Guarantee Policy. We will not issue a refund inside the 30-day cancellation period, but The Vacation Guarantee Protection Policy allows you to reschedule your dates with a Credit Voucher that will be valid for 5 Years. In the event you choose new dates, you will have to purchase the Vacation Guarantee for your new dates. There will never be a refund available with a Vacation Guarantee voucher on new or future stays that have been booked with your voucher. 

RATES: Rates are subject to change without notice and a guaranteed reservation with a paid deposit. Quoted or published rates do not include applicable taxes and fees

TAX: A City and State tax totaling 12.25% is added to all reservations. This waiver of tax is applicable only to the rental rate, and all taxes associated with fees will still be charged to the guest. The tax rate is subject to change based on governing City and State regulations. Any additional funds due to these changes will be charged to the guest. There is a 3% admin fee that is charged to all reservations that are being paid for with a credit card.

RENTER AGREES: To be responsible for any intentional damage or negligence resulting in damage to the premises, including damages to the furnishings and household items, which occur as a result of your occupancy, excluding normal wear and tear or accidental damage up to $100. An additional cleaning charge may be incurred if upon departure the property is inspected and found to require more than the normal checkout cleaning. Agent or owner will not be liable for any damages to your property, nor liable for any accident that may occur to you during your occupancy in or on the property. Owner or Agent may re-enter premises at a reasonable time for the purpose of making repairs or for routine maintenance. The Owner or Agent is not responsible for articles left on the premises. All properties are nonsmoking. We make every attempt to make sure the home or villa you’ve rented is in good working order when you arrive. If you do encounter a maintenance problem in the home or villa, it will be handled in a timely and professional manner. The rental rate will not be adjusted due to any malfunction of equipment. Smoky Mountain Escapes is not responsible for resort amenities such as scheduled pool and spa closures, etc. At the time of this publication, all unit amenities are accurate to the best of our knowledge. Furniture and accessories are subject to change as owners may update their properties.

COMPLEX/COMMUNITY RULES & REGULATIONS: Renters are responsible for adhering to all rules and regulations of the complexes or communities of the rental property. Failure to comply with complex rules can result in immediate cancellation of your rental reservation and occupancy of the dwelling. Additionally, the Guest will forfeit all monies and will be responsible for any fines, tickets, or other penalties due to inappropriate behavior. Highland Rentals reserves the right to adjust and/or amend this agreement.

CHECK-IN is anytime after 4:00 p.m. – CHECK-OUT is by 10:00 a.m. on the day of departure. The renter agrees to schedule arrival and departure times. We make every effort to ensure your property is ready by 4:00 p.m. but we cannot guarantee it on heavy turnaround days or days of inclement weather.

GUEST: The guest understands that should the property become unavailable for the guest’s use through the sale of the premises or other disposition, owner occupancy of premises, or other circumstances beyond the reasonable control of the rental agent, the agent may substitute with the best available, comparable resort accommodations for the same period.

PETS: Guests are NOT permitted to bring pets into any of our vacation rental condos. 

SERVICE DOGS: Smoky Mountain Escapes will comply with state and federal laws concerning licensed service animals only. We will not allow emotional support animals of any kind. If pets are found in units that are not licensed service animals, there will be a minimum $1,000.00 non-refundable fee charged to the card on file without notice to the guest. 

CAR PASSES: Each registered guest must have a visible parking pass given by the rental company. In accordance with association ordinances, parking is strictly enforced. All vehicles must be in designated parking spaces, parking along roadways, and non-approved locations, including but not limited to, grass/lawns, mountain paths, wooded areas, etc is prohibited. Failure to comply with parking limitations and rules could result in the vehicle being removed from the property at the vehicle owner’s expense. Owner nor agent is responsible for any damages to vehicles during your stay.

PROHIBITED VEHICLES: Trailers, U-hauls, Motor Homes, and/or commercial or recreational vehicles are prohibited.

GARAGES: The garages have assigned parking and are not open to all units.  

FIREPLACE: For units with fireplaces, we will not offer any discounts or refunds in the event the fireplaces are down for maintenance. 

ELEVATORS: Elevators are available for guest use in select properties. However, Smoky Mountain Escapes cannot guarantee functionality & refunds will not be given if a malfunction occurs.

LOST AND FOUND: Lock all doors when you leave your accommodations. Do not leave money or valuables unattended in the property; neither the Agent nor the owner will be held accountable or liable for any thefts. Items left behind will be returned only upon request, and there will be a minimum charge of $50 for shipping items.

REPAIRS: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Smoky Mountain Escapes uses the best maintenance personnel available. Problems are corrected as soon as possible. Agent or an authorized employee or repairman may enter the premises during business hours for any purpose connected with the repair, care, or maintenance of the premises. Refunds will not be issued due to malfunctioning equipment or other guest dissatisfaction. East Tennessee a highly desirable developing resort area with houses under construction. We do not move people or give refunds due to construction noise. 

USE: Any use of the dwelling other than residential use during a family vacation must be approved by the Agent. If the dwelling is to be used for any event such as weddings, receptions, “parties” or large gatherings, the Guest agrees to submit a request for approval to the Agent and adhere to the Agent’s determination on that request. If the Agent approves the event, the Guest may be required to pay an additional deposit. If the Guest misrepresents an event to the Agent (said misrepresentation to be determined by the Agent), the Guest agrees that the Agent may refuse occupancy or have the dwelling vacated and that the Guest will not be entitled to any refund.

RELEASE AND WAIVER OF LIABILITY FOR UNITS WITH POOLS: I understand that swimming is an inherently dangerous activity, which can result in illness, serious bodily injury, or death. I further understand that my entire family and all of my guests are being permitted to use the swimming pool at the property we are renting and that we are aware we are swimming at our own risk. I, on behalf of myself and my entire family and all of my guests, do hereby release and forever discharge Highland Rentals and all owners of said property, from and against any liability or responsibility for claims, damages, causes of action, or other suits, whether based in law or equity, or in tort or contract for any illness, bodily injury, personal injury, death or as a result of the use of the swimming pool or on the premises on which said pool is located. By signing this rental agreement you are agreeing to a release and waiver of liability concerning any and all injuries, illness, or death which occur during your stay at any of our properties and also while you or your family or guests are being permitted to use the complex amenities at your own risk. 

INDEMNIFICATION OF AGENT BY GUEST: Guest agrees to indemnify and hold Owners of Dwelling and Agent, its employees and Agents, free and harmless from any claim or liability for any loss, damage, or personal injury sustained by a Guest or any Guest invitee when using the Dwelling, the pool/hot tub (if applicable), elevator (if applicable) or any other amenities related to the Dwelling or Complex. This Agreement shall be construed according to, and enforceable under, the law of the State of Tennessee 

All payments will be charged to the credit card on file.
